ORDINANCE NO. 655 – Open Burning

ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF CARLISLE, IOWA, 2006, REGARDING OPEN BURNING

BE IT ENACTED by the City Council of the City of Carlisle, Iowa:

SECTION 1. Chapter 105 Section 05 of the Code of Ordinances of the City of Carlisle, Iowa 2006 is repealed and the following adopted in lieu thereof:

105.05 OPEN BURNING PROHIBITED. No person shall allow, cause or permit the open burning of any combustible materials, including but not limited to yard or landscape waste, leaves and tree limbs, except that the following shall be permitted

  1.  
    1. Fire pits;
    2. Fires used for recreational cooking purposes, i.e. camp fires or barbecues;
    3. Fires related to scouting activities;
    4. Fires celebrating school pep rallies;
    5. Burning of trees after clearing for construction with a permit issued by the City Council;
    6.  Fires for prairie burns with permit issued by the City Council;
    7. Training fires set for the purpose of bona fide training of public or industrial employees in firefighting methods, provided that written notification is delivered to the City Administrator at least ten (10) working days before such action commences. All asphalt, roofing and materials containing asbestos shall be removed prior to the training fire; and
    8. Customary burning of logs and other wood products in residential fireplaces.
       
  2. Violations of this subsection may be charged under the Municipal Infraction procedure with a warning citation for the first offense, a fifty dollar ($50.00) penalty for the second repeat offense and a one hundred dollar ($100.00) penalty for each additional repeat offense.

SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

SECTION 3. SEVERABILITY CLAUSE. If any section, provision or part of this Ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudicated invalid or unconstitutional.

SECTION 4. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
